Terms and Conditions

§ 1 Scope and Contracting Party

(1) These Terms and Conditions (hereinafter “Terms”) apply to all contracts concluded between

(hereinafter “Operator”) and the user (hereinafter “User”) via the platform LEASH (hereinafter “Platform”).

(2) Use of the Platform is exclusively permitted for natural persons of legal age (18 years or older). By registering, the User confirms that they have reached the age of 18.

(3) Deviating, conflicting, or supplementary terms and conditions of the User shall not become part of the contract unless the Operator expressly agrees to their validity in writing.

§ 2 Description of Services

(1) LEASH is an online platform that enables interactions in the area of BDSM and fetish. The Platform offers the following features in particular:

• Creation of user profiles in the roles “Domina” or “Slave”
• Marketplace for finding and applying to other users
• Messaging system for communication between users
• Task and rule system within relationships
• Payment system for tribute payments between users

(2) The Operator merely provides the technical infrastructure. The Operator is not a party to agreements concluded between users and is not liable for their content or fulfillment.

(3) The Operator reserves the right to further develop the Platform and to change the scope of features at any time, provided this is reasonable for the User.

§ 3 Conclusion of Contract and Registration

(1) The user agreement is concluded upon registration on the Platform. Registration is carried out via email authentication (magic link).

(2) By registering, the User agrees to these Terms and the Privacy Policy.

(3) The User is obligated to provide truthful information during registration. Each User may only create one account.

(4) There is no entitlement to registration. The Operator reserves the right to reject registrations without stating reasons.

§ 4 User Obligations

(1) The User undertakes to use the Platform only in accordance with applicable laws and to respect the rights of third parties.

(2) The User is specifically prohibited from:

• Publishing or sending content that violates applicable law, in particular content that is harmful to minors, glorifies violence, is racist, defamatory, or constitutes pornography within the meaning of § 184 StGB et seq.
• Publishing content that depicts minors or targets minors
• Harassing, threatening, or pressuring other users — all interactions must take place on a consensual basis
• Impersonating false identities or posing as other persons
• Using the Platform for commercial purposes beyond the intended features
• Using automated systems (bots, scrapers, crawlers) to access the Platform
• Disrupting or overloading the technical infrastructure of the Platform

(3) The User is solely responsible for all content they publish or send on the Platform. The User shall indemnify the Operator against all third-party claims arising from legal violations caused by content posted by the User.

(4) The User is obligated to keep their access credentials confidential and not to share them with third parties. In the event of suspected misuse, the Operator must be notified immediately.

§ 5 Content and Moderation

(1) The Operator is entitled, but not obligated, to review content posted by users. The Operator reserves the right to remove content without prior notice that violates these Terms, applicable law, or public decency.

(2) Users may report content that is unlawful or violates these Terms via the Platform's reporting function. The Operator will review reports promptly and take appropriate action where necessary.

(3) The Operator is obligated under the Digital Services Act (DSA, Regulation (EU) 2022/2065) to provide a reporting mechanism for illegal content. Users may report illegal content via the designated reporting function or by email to contact@myleash.app.

§ 6 Payments and Tributes

(1) Basic use of the Platform is free of charge. Certain features, in particular the ability to make tribute payments, may be subject to charges.

(2) Tribute payments are voluntary payments made by users in the “Slave” role to users in the “Domina” role. The Platform acts as an intermediary and payment processor.

(3) A platform fee of 35% of the gross amount is deducted from each tribute payment. The remaining amount (65%) is credited to the recipient.

(4) Payouts to users are made in accordance with the payout terms displayed on the Platform. The Operator reserves the right to temporarily suspend payouts in case of suspected misuse or legal violations.

(5) All amounts displayed on the Platform include statutory value-added tax where applicable.

§ 7 Liability

(1) The Operator is liable without limitation for damages arising from injury to life, body, or health based on an intentional or negligent breach of duty by the Operator, as well as for other damages based on an intentional or grossly negligent breach of duty by the Operator.

(2) In the event of a breach of material contractual obligations (cardinal obligations), the Operator is also liable for slight negligence, but limited to the foreseeable, typically occurring damage.

(3) In all other respects, the Operator's liability is excluded.

(4) The Operator is not liable for the content, actions, or omissions of users.

(5) The Operator does not guarantee the continuous availability of the Platform.

§ 8 Termination and Suspension

(1) The User may terminate the user agreement at any time without notice by deleting their account via the account settings or by email to contact@myleash.app.

(2) The Operator may terminate the user agreement with 14 days' notice.

(3) Good cause for extraordinary termination exists in particular if the User violates these Terms or applicable law, provided false information, harasses other users, or uses the Platform for unlawful purposes.

§ 9 Copyright and Usage Rights

(1) By uploading content, the User grants the Operator a simple, non-exclusive, royalty-free right to store, display, and transmit the content within the scope of Platform operations.

(2) The User warrants that they hold all necessary rights to the content they upload.

(3) Rights to the Platform itself (design, code, brand) remain with the Operator.

§ 10 Applicable Law and Jurisdiction

(1) The law of the Federal Republic of Germany applies, excluding the CISG.

(2) If the User is a merchant, jurisdiction is Berlin.

(3) For consumers, statutory provisions on jurisdiction apply.

§ 11 Severability Clause

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
